Super Bowl XXXVIII, which had been broadcast on 1st of February, 2004 from Houston, Texas is among some of the controversial events had been noted by the CBS TV network which was about the activities of Janet Jackson in the half time show. It was notable as the controversial scene, halftime present the breast of Janet Jackson, hemmed with a breast plate. Justin Timberlake exposed it for around half of a second which was later called as "wardrobe malfunction".

The incident is known as "Nipple gate" which was extensively discussed together as it was an indication of immoral culture. This incident led the environment to an instantaneous crackdown and created a situation of debate after the broadcasting. As a result, the media CBS was heavily penalized around $550, 000 by the Federal Communications Commission (FCC) for the violation of law and order which was against the national morality.

This halftime show was developed with the co-ordination of MTV and was purportedly selected across the Rock of network in the Vote campaign. Even though the theme was immediately distributed for the first moment to display without any statement following the stage. There were two media channels such as- CBS and MTV which had been owned by Viacom, a media group. In January 2006, the Viacom organizations ended up and split into separate entities, with CBS getting to be part of the CBS Corporation and MTV becoming a portion of the new Viacom group. Subsequent the event, the NFL declared that MTV as halftime display of Super Bowl XXXV that would never be associated with any other halftime show.
